The apex court asked the heads of the National Company Law Tribunal and its appellate body to provide detailed proposals on infrastructure, staffing and administration within a month.
Supreme Court's bench expressed concern that the functioning of the National Company Law Tribunal (NCLT) and the National Company Law Appellate Tribunal (NCLAT) appears to be overly influenced by the Ministry of Corporate Affairs, describing it as a “complete hijack”.
In response, the bench directed the presidents of both tribunals to submit comprehensive proposals covering infrastructure upgrades, staffing requirements and administrative arrangements.
The submissions are to be filed within four weeks of the order, allowing the court to assess whether the tribunals have adequate resources and independence to handle corporate disputes.
Legal experts note that the directive underscores the judiciary’s intent to ensure the tribunals operate without undue executive interference, which could affect the resolution of insolvency and corporate restructuring cases.
The court will review the proposals before deciding on any further measures to safeguard the autonomy of the NCLT and NCLAT.
