A High Court in Indore has imposed a ₹1 lakh fine on a municipal officer for issuing an order based on provisions that have been annulled, ruling that the officer must pay from personal funds.

The Madhya Pradesh High Court in Indore has levied a ₹1 lakh penalty on a municipal officer for issuing an order that relied on legal provisions which had been annulled. The decision was taken in the context of a case involving Bafna Hospital, where the officer’s directive was found to be unsupported by current law.

The court held that the officer’s action constituted a breach of statutory procedure, and therefore the fine was imposed as a punitive measure. Importantly, the judgment directed that the amount be paid from the officer’s personal pocket, not from the municipal treasury.

This ruling underscores the judiciary’s stance on ensuring that public officials adhere strictly to the law. It also serves as a warning to other officers that issuing orders based on obsolete or invalid provisions can lead to personal financial liability.

The officer has been notified of the fine and is required to submit the payment within the stipulated time. Failure to comply could result in further legal action.

The High Court’s decision is expected to reinforce accountability within local governance bodies across Madhya Pradesh.
