Despite the passage of the Bharatiya Nyaya Sanhita, the section dealing with hit‑and‑run cases has not yet been enforced, leaving a legal gap for two years.
The Bharatiya Nyaya Sanhita, a comprehensive criminal code drafted by the Indian government, was approved by Parliament in 2024. However, the provision that criminalises hit‑and‑run incidents has not yet been brought into force, according to a statement from the Ministry of Law and Justice. The delay means that offenders who leave the scene of an accident are still prosecuted under the old Indian Penal Code, which does not contain a specific hit‑and‑run clause. Legal experts say the omission could affect the speed and severity of punishment for such cases. The government has said it is working on finalising the section, but no timeline has been announced.
