A court awarded Rs 10 lakh to a widow after an insurance company rejected her claim following a fatal crash, citing an expired driving licence as the reason for denial.
A legal dispute regarding an insurance claim has been resolved in favour of a bereaved family. The case centred on a fatal road accident where the insurer initially refused to pay out the compensation.
The insurance company had rejected the claim on the grounds that the deceased driver's licence had expired at the time of the incident. This technicality was used by the insurer to deny liability for the death.
However, the court did not accept the insurer's argument as a valid reason to completely bar the claim. Recognising the hardship faced by the family, the judge ordered the payment of Rs 10 lakh to the widow.
This verdict highlights the judicial approach towards balancing contractual terms with the fundamental right to compensation in cases of fatal accidents, ensuring that technical lapses do not entirely negate the victim's entitlement to financial relief.
