The Supreme Court has rejected MP Mahua Moitra's plea demanding that the names of beneficiaries of Alternative Investment Funds and Foreign Portfolio Investors be made public.

The apex court disposed of a petition filed by Trinamool Congress MP Mahua Moitra that sought a court‑ordered disclosure of the identities of beneficiaries of Alternative Investment Funds (AIFs) and Foreign Portfolio Investors (FPIs). The bench, after hearing the arguments, concluded that the matter does not merit judicial intervention at this stage and declined to order the release of the information.

Moitra had argued that transparency about AIF and FPI beneficiaries is essential to curb potential misuse of funds and protect the interests of small investors. The court, however, noted that existing regulatory frameworks already provide mechanisms for oversight and that a blanket public disclosure could breach confidentiality provisions under securities law.

The decision leaves the issue within the purview of the Securities and Exchange Board of India (SEBI) and other regulatory bodies, which may consider further guidelines if deemed necessary. Legal experts say the ruling underscores the balance courts must maintain between transparency and privacy in financial markets.

No further orders were issued, and the petition was dismissed without prejudice, allowing Moitra to approach the court again if new material emerges.
