The Madhya Pradesh High Court in Gwalior has declared the 10% promotion quota for clerks in the prosecution department unconstitutional, nullifying the provision. Recruitment for the Assistant District Public Prosecutor positions will now be through the State Public Service Commission alone.
The Madhya Pradesh High Court, sitting in Gwalior, ruled on Tuesday that the 10% promotion quota reserved for clerks in the prosecution department to become Assistant District Public Prosecutors (ADPOs) is unconstitutional. The court held that the quota violated the principles of equality and merit in public service appointments.
The decision effectively annuls the provision that had allowed a fixed percentage of clerks to be promoted to ADPOs. Consequently, all future appointments to the ADPO post will be made solely through the Madhya Pradesh State Public Service Commission (MPSPSC) recruitment process.
The ruling was welcomed by several civil service groups who argued that the quota created an uneven playing field. The court also directed the prosecution department to cease using the quota immediately and to ensure that future recruitment follows the standard MPSPSC guidelines.
The prosecution department has indicated that it will comply with the court’s directive and will submit a revised recruitment plan to the MPSPSC by the end of the month.
