A Mohali consumer commission has directed a real estate developer to pay 9% interest on delayed possession, rectify construction defects, and refund illegal maintenance charges, awarding Rs 75,000 as compensation for mental anguish.

A consumer commission in Mohali has issued a significant ruling in favor of a homebuyer who faced multiple issues with a real estate developer. The commission has directed the developer to pay 9% interest on the amount paid for the delayed possession of the flat. This financial penalty is intended to compensate the buyer for the time lost due to the developer's failure to deliver the property on schedule.

Beyond the financial interest, the commission has ordered the developer to rectify specific construction defects within the unit. Additionally, the developer is required to restore the buyer's original parking space, which had been compromised or altered without proper authorization. These structural and logistical corrections are mandatory to ensure the property meets the promised standards.

The commission also addressed the issue of illegal maintenance charges that were previously levied on the buyer. An order has been passed to refund these amounts, as they were deemed unjustified. In recognition of the stress and mental anguish caused by these cumulative failures, the commission awarded the homebuyer a compensation of Rs 75,000. This ruling serves as a reminder to developers in the region to adhere strictly to consumer protection laws and contractual obligations.
