The Karnataka High Court observed that the 2023 Act intended to streamline government litigation is itself suffering from bureaucratic delays, with appeals failing to meet statutory time limits.

The Karnataka High Court has highlighted a significant irony regarding the implementation of the Karnataka Conduct of Government Litigation Act, 2023. The Bench noted that while the legislation was designed to curb red tapism and ensure timely legal proceedings by government officers, it is currently bogged down by the very bureaucratic inefficiencies it sought to eliminate.

The court pointed out that the Act prescribes strict adherence to the period of limitation for preferring appeals, reviews, or revisions against court verdicts. However, the judges observed that none of the pending appeals in the current case demonstrate the statutory discipline contemplated by the law.

This observation underscores a gap between legislative intent and administrative execution. The court's remarks suggest that without strict internal compliance by government departments, laws aimed at improving judicial efficiency may fail to achieve their intended outcomes.

The ruling serves as a critical reminder to state administration to enforce internal deadlines rigorously to align with the statutory requirements of the 2023 Act.
